Lawmakers urge DOL to reconsider proposed changes affecting disability employment

Education and Workforce Committee Chairman Tim Walberg, along with Representatives Virginia Foxx, Glenn Thompson, and Glenn Grothman, have expressed their concerns over the Department of Labor's proposed rule to halt the issuance of 14(c) certificates. These certificates are crucial for expanding employment opportunities for individuals with physical and mental disabilities.

In a letter addressed to Acting Secretary Julie Su, the representatives argued that eliminating these special minimum wages would reduce employment options for individuals with significant intellectual and developmental disabilities. They emphasized that "these workers deserve to be able to choose the type of employment that works for them," warning that removing access to such tools could further limit their choices.

The letter also highlighted the broader impact on workers who rely on their jobs not just for income but also for skill development and personal fulfillment. Quoting President Biden, they noted: "a job is about a lot more than a paycheck. It’s about your dignity. It’s about respect. It’s about your place in your community."

Additionally, the representatives criticized the short 44-day public comment period allowed by the proposed rule, which they believe fails to gather sufficient feedback from stakeholders. They mentioned that a study by GAO on state governments' elimination of 14(c) certificates is pending and will provide important insights relevant to this rulemaking process.

Previously, on December 31, 2024, committee members urged Acting Secretary Su to extend the public comment period and reassess changes impacting Americans with disabilities. The committee had also condemned similar proposals from the Biden-Harris administration earlier in December.
