Education and the Workforce Committee Chairwoman Virginia Foxx has addressed a letter to Acting Secretary Su, urging the Department of Labor (DOL) to comply with a subpoena issued by the Committee. The subpoena is part of an investigation into the Biden-Harris administration's actions regarding independent contractors.

Foxx expressed concerns over what she describes as "the Biden-Harris administration’s efforts to eliminate the use of the independent contractor model under the Fair Labor Standards Act (FLSA)." She stated that previous attempts by the Committee to obtain information from DOL have been unsuccessful, leading to the issuance of a subpoena on September 23, 2024.

According to Foxx, "DOL’s most recent response amounts to a failure to comply with the subpoena and is another glaring example of the Biden-Harris administration’s hostility to Congress and its duty to conduct oversight."

The response from DOL, dated October 7, was deemed insufficient by Foxx. She criticized it for not meeting congressional inquiry standards and not fulfilling obligations set by the subpoena.

In her letter, Foxx insists on complete compliance with the document schedule outlined in the subpoena. She challenges DOL's claim that protecting investigative information is a valid reason for withholding documents from Congress. The Committee expects a full response by October 30, 2024.
