Foxx emphasized the significance of this decision, stating, "I rise today to report to the House that Article III courts have once again protected the American people from extreme executive overreach."
Foxx expressed optimism regarding the future of the borrower-defense scheme, noting, "This key decision gives strong reason to believe that the borrower-defense scheme will be permanently scuttled." The ruling by the 5th U.S. Circuit Court of Appeals was seen as a significant setback for the Biden administration's efforts to implement widespread student loan forgiveness.
In her remarks, Foxx highlighted the court's assessment, quoting Judge Edith Jones who stated, "We assess a strong likelihood that the plaintiffs will succeed on the merits in demonstrating the Rule’s numerous statutory and regulatory shortcomings." This legal victory was viewed as a positive outcome for taxpayers and Americans impacted by student loan policies, as Foxx noted, "This is a grand slam for taxpayers and for every American who never stepped foot on a college campus yet have been forced to pay for others’ student debt."
