The Education and the Workforce Committee Chairwoman Virginia Foxx (R-NC) has released a report detailing the National Labor Relations Board’s (NLRB) alleged misconduct in mail ballot elections. According to Chairwoman Foxx, the NLRB has jeopardized the integrity of union elections through procedural irregularities, resulting in the disenfranchisement of workers. The report highlights concerns about the NLRB's handling of mail ballot elections, citing instances of administrative changes that may have compromised the voting process.
The NLRB's decision in the Aspirus Keweenaw case in November 2020, which allowed regional directors to order mail ballots due to the COVID-19 pandemic, significantly increased the use of mail-in voting for union elections. Subsequent allegations of interference in representational elections involving Starbucks and Workers United prompted an investigation by Chairwoman Foxx in August 2022.
Despite inquiries and requests for information, the NLRB's responses were deemed insufficient until November 2023 when the agency provided thousands of documents. These documents reportedly revealed instances of misconduct and failure to adhere to election procedures, raising doubts about the NLRB's ability to conduct mail ballot elections reliably.
In March 2023, a subpoena was issued to a whistleblower within the NLRB, leading to the submission of over 500 pages of documents that further highlighted staff misconduct and non-compliance with election protocols.
